The city has asked a court to dismiss Al Madany Islamic Center of Norwalk's lawsuit against the city's Zoning Commission's after the commission last summer rejected the center's plan for a mosque and community hall on Fillow Street.
Attorneys representing the city and its Zoning Commission this week filed with the U.S. District Court in New Haven a motion to dismiss the case.
In a memorandum accompanying the motion, the attorneys argue that the lawsuit is "unripe" for adjudication in federal court, because Al Madany Islamic Center hasn't first appealed to state Superior Court, and that Al Madany didn't explore reasonable alternatives to the development plan as proposed.
